Bylaws of TCNJ MENC

Bylaw 1: Purpose of bylaws

“The Bylaws document of TCNJ MENC exists to facilitate the operation of the organization by the Executive Committee. A new bylaw, the modification of an existing bylaw, or the removal of a bylaw must be proposed to the Executive Committee by any member of the organization. The Committee shall discuss the proposed bylaw (or change to a bylaw). The Committee shall vote on the bylaw; a majority must approve for the bylaw to pass. If the bylaw passes, it shall take effect immediately.”

“The Executive Committee shall have the authority to pass bylaws regarding the following subjects: creation, appointments, and duties of committees; financial planning; setting regular and special meeting times and locations; other issues not specifically addressed nor prohibited by [the] constitution.” - From the TCNJ MENC Constitution, Article VI

Bylaw 2: Organization of the Bylaws document

The Bylaws document shall be structured as follows:

  • Numbered starting 1: Bylaws regarding this document, and other general organizational bylaws.
  • Numbered starting 101: Bylaws establishing and defining rules of membership. Bylaws establishing rights, privileges, and duties of members.
  • Numbered starting 201: Bylaws governing general meetings and electoral meetings.
  • Numbered starting 301: Bylaws governing the Executive Committee. Bylaws establishing special rights, privileges, and duties of Executive Committee members.
  • Numbered starting 401: Bylaws establishing and defining the duties of standing and temporary committees. Bylaws establishing and defining duties of committee members.
  • Numbered starting 501: Bylaws concerning finances and fiscal policy.
  • Numbered starting 601: Bylaws establishing and defining recurring TCNJ MENC-sponsored events.
  • Numbered starting 701: Miscellaneous bylaws.

Bylaw 100-series: Bylaws establishing and defining rules of membership. Bylaws establishing rights, privileges, and duties of members.

Bylaw 101: Procedure for application of membership

Any person eligible for membership in TCNJ MENC as stated in the Constitution, Article III Section 1, must obtain an “Application for Collegiate Membership” from MENC.

This form must be returned to TCNJ MENC with the proper amount of dues as indicated on the form, no later than the first Friday in October of each academic year.

Applications for membership returned later than this deadline may be rejected by TCNJ MENC; they may also be accepted on a case-by-case basis.

It is understood that TCNJ MENC will make every effort to ensure the availability of the membership application and opportunities to submit the application.

Bylaw 102: Active versus inactive membership

To be considered an active member, a member must have attended the last three general meetings of the previous academic year and/or must attend at least five meetings of the present academic year.

Bylaw 103: Rights and privileges of members

Active members will also be given free admission into any TCNJ MENC function. Written excuses will be allowed, depending upon the excuse given. Inactive members (i.e. they do not show up to general meetings) will have to pay for MENC events in full.

Bylaw 104: Duties of members

Active members will have to attend meetings regularly, assist with at least one event, and be on one event committee. Also, if one would care to be TCNJ’s Vice President, that person would have to be a junior or below, so that the Vice President could learn how to effectively govern MENC from the President for an entire year.

Bylaw 105: Probation of members

TCNJ MENC is not capable of revoking a student’s membership in MENC. However, TCNJ MENC may place a member on probationary status.

Probation may only be considered in the following cases: dereliction of an assigned duty, serious disruption of a meeting or event, or performing illegal actions while representing TCNJ MENC.

The Executive Committee may place a member on probation by a two-thirds majority vote.

A member placed on probation may not attend TCNJ MENC meetings or events, may not be involved in any cooperative attendance of MENC functions, and may not vote or run for office.  Probation shall last one academic year from the time it is assigned.

Bylaw 200-series: Bylaws governing general meetings and electoral meetings.

Bylaw 201: General meeting dates, times, and locations

General meetings must be held at least once each month, and must be publicized at least one week in advance, according to the Constitution, Article IV, Section 1.

This bylaw should be amended each year to set a specific recurring date, time, and location for general meetings.

Bylaw 202: General meeting agenda format

The agenda for each general meeting shall be made available at least one day prior to the meeting. The agenda shall be in the following format:

  1. Opening / attendance
  2. Officers’ reports
    1. President
    2. Vice President
    3. Secretary
    4. Treasurer
    5. State Representative
  3. Committee reports
  4. Old business
  5. New business
  6. Closing

Old business is defined as business that has been discussed at prior meetings and needs to be revisited. New business is defined as business that has not been discussed before.

All portions of the general meeting are open to full member participation; there are no defined comment periods or closed sessions.

Bylaw 203: Electoral meeting procedures

This bylaw has not yet been written.

Bylaw 300-series: Bylaws governing the Executive Committee. Bylaws establishing special rights, privileges, and duties of Executive Committee members.

Bylaw 400-series: Bylaws establishing and defining the duties of standing and temporary committees. Bylaws establishing and defining duties of committee members.

Bylaw 401: Creation of standing and temporary committees

Necessary committees will be created at the discretion of the executive board.

Bylaw 402: Membership and Recruitment Committee

This bylaw has not yet been written.

Bylaw 403: Fundraising Committee

This bylaw has not yet been written.

Bylaw 500-series: Bylaws concerning finances and fiscal policy.

Bylaw 501: Financial accounts held by TCNJ MENC

Financial accounts held by TCNJ MENC cannot fall below $100 at any time.

Bylaw 600-series: Bylaws establishing and defining recurring TCNJ MENC-sponsored events.

Bylaw 601: Welcome back reception

The TCNJ MENC welcome back reception will be annual. The date of the function will be determined by May 30 by the executive board. Also, information for freshmen, elementary education majors, and transfers will be provided at this annual meeting.

Bylaw 602: Policy for NJEA, NJMEA, and MENC conventions

All convention forms (for MENC, NJEA, NJMEA, etc.) will only be accepted from MENC members who submit these forms at the beginning of the school year.

Bylaw 603: State Collegiate Convention

This bylaw has not yet been written.

Bylaw 604: Directory of Musicians

The directory of musicians should be published and distributed by October 15 of every year.

Bylaw 700-series: Miscellaneous bylaws.
